The Head of Environment and Planning submitted a report (HEP/02/18) for Members’ consideration of planning applications and attention was drawn to his Addendum Report where relevant.

 

Application Code No. P/2016/0871 – Relaxation of Condition 1 imposed under Planning Permission P/2010/0733 to extend the period within which to commence development for a further period of three years (erection of 17 dwellings and associated works) on land off Blast Road, Brymbo, Wrexham.

 

During consideration of the application several Members, including the Local Member (Councillor Paul Rogers), commented that planning permission had originally been granted in 1999 and that this would be the fourth renewal of this proposal for residential development.  The extant planning permission had been subject to a Section 106 planning obligation to secure public open space, however, no financial contributions has been required for primary and/or secondary education provision.  Mention was made of the many changes that have been made to the local infrastructure since the original planning permission had been granted. Therefore, it was suggested that consideration of the application be deferred to allow the Head of Environment and Planning time to further investigate with the Head of Education the possible need for a financial contribution towards education provision in the locality.  This was agreed by the Committee.

 

RESOLVED – That consideration of the application be DEFERRED to allow the Head of Environment and Planning time to make enquires on whether a financial contribution to provide for primary and/or secondary education provision should be included in the Section 106 obligation so that the application could be considered by the Committee on the basis of the fullest information possible.

Application Code No P/2017/0319 – Demolition of existing structure and erection of 9 No. Affordable Homes Apartments with associated parking and access at English Methodist Chapel, High Street, Brymbo, Wrexham.     

 

The Local Member (Councillor Paul Rogers) indicated his objection to the Officer recommendation to amend the Section 106 Planning obligation to waive the financial contribution towards the shortfall in provision of education facilities.  A concession had already been made on the provision of maximum car parking spaces in recognition that the proposed development would bring into use the development of a redundant site.  In his opinion, waiving the requirement for a financial contribution could have a detrimental impact on the  capacity of local schools to accommodate the proposed development and requested that the application be refused.

 

During consideration of the application Members considered the financial viability assessment submitted by the applicant.  After hearing the views of Members it was

 

RESOLVED – That permission be REFUSED.

 

Reason

The lack of a financial contribution towards a shortfall in education provision will result in a detrimental impact upon existing community infrastructure and the capacity of local schools to accommodate the proposed development.  To allow the development without such provision would be contrary to Policy GDP2 of the adopted Wrexham Unitary Development Plan.
