RESOLVED – That the Minutes of the Meeting held on 26 November 2018 be signed as a correct record.

53.

Exclusion of Press and Public

In considering whether to exclude the press and public from the next part of the meeting, Members are asked to consider the following factors when determining the public interest test.

 

Agenda Item 6 – 8:  The Proper Officer has determined in considering this report that Paragraph 12 should apply.  Her view on the public interest test was that to make this information public would disclose personal data relating to an individual in contravention of the principles of the Data Protection Act.  Because of this and since there did not appear to be an overwhelming public interest requiring the disclosure of personal data she felt that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

 

It is therefore recommended that the press and public be excluded from the Meeting during consideration of the following items as it is likely that, if they were present, there would be disclosure to them of exempt information as defined in Paragraph 12 of Part 4 of Schedule 12A to the Local Government Act 1972 (as amended).

Agenda Items 6 to 8: Members determined in considering these reports that Paragraph 12 should apply. Variation in order of agenda

Minutes:

The Committee were informed that the complainant in respect of Agenda Item 6 had not yet arrived.  Members agreed to defer consideration of this item to later in the meeting.

 

RESOLVED – That Agenda Item 7 be brought forward and taken at this time.

55.

Conduct of Private Hire Driver/Hackney Carriage Driver

To consider the report of the Head of Environment and Planning

Minutes:

The Head of Environment and Planning submitted a report (HEP/99/18) to consider the conduct of a Private Hire Driver / Hackney Carriage Driver.  Members considered the report and the representations of the Driver.

 

RESOLVED –

 

(i)         That the Private Hire Driver’s Licence and Hackney Carriage Driver’s Licence referred to in report HEP/99/18 be suspended for a period of 1 month under Section 61(1)(b) of the Local Government (Miscellaneous Provisions) Act 1976 on account of his recent convictions.

 

(ii)        That the Head of Environment and Planning write to the Private Hire / Hackney Carriage Driver referred to in report HEP/99/18 expressing the concern of the Committee regarding his recent conduct and to issue a warning as to his future conduct.

Conduct of a Private Hire Driver

To consider the report of the Head of Environment and Planning

Minutes:

The Head of Environment and Planning submitted a report (HEP/98/18) to consider the conduct of a Private Hire Driver.  The Committee were informed that the complainant had indicated that she was unable to attend today’s meeting.  Members considered the report and the representations of the Driver and his representative.

 

RESOLVED – That the Committee find that on the balance of probabilities the allegations set out in report HEP/98/18 were not made out.

57.

Conduct of a Private Hire Driver

To consider the report of the Head of Environment and Planning

Minutes:

The Head of Environment and Planning submitted a report (HEP/97/18) to consider the conduct of a Private Hire Driver.   The Committee were informed that the Driver had not attended today’s meeting and had given no reason for not doing so.  Noting that this matter had been deferred at last month’s meeting to afford the Driver further opportunity to attend Members considered the report.

 

RESOLVED – That the Private Hire Driver’s Licence and Hackney Carriage Driver’s Licence referred to in report HEP/97/18 be suspended for a period of 1 month under Section 61(1)(b) of the Local Government (Miscellaneous Provisions) Act 1976 on account of his recent convictions.
