Councillor Michael James Dixon  – Personal – Application No. P/2019/0484. The company had made a donation to a Charity that the Member is a trustee of. The Councillor remained in the meeting and took part in the discussion and voting thereon.

 

Agenda Item 6 – Tree Preservation Order 293/2019 – Llwyneinion Woods, Rhosllanerchrugog

 

Councillor Paul Pemberton – Personal and Prejudicial - Application Code No. TPO 293/2019. Representations had been made to the Councillor by the alleged owners.  The Councillor withdrew from the meeting for this item taking no part in the discussion and voting thereon.

The Planning Control Lead advised that a number of objections had been received and subsequently forwarded to Highways Department for their comment.  To allow sufficient time to consider the representations made it was recommended that consideration of the application be deferred.

Councillor Paul Roberts referred to the comments by the Flood Officer relating to the private soakaway. The Planning Control Lead confirmed that there were conditions in place to deal with the discharge to highway drains and the discharge of surface water.

The Chair introduced the application to all those present.

 

Mr Richard Fogg (Local Resident) spoke against the application.

Mr Andrew Shield (Applicant) spoke in support of the application.

 

Councillor R Alun Jenkins (Local Member) indicated his objection to the application as, in his opinion, the proposed development would lead to an increase in demand for on street parking in the vicinity of the site, exacerbating existing parking problems. In addition, Councillor R Alun Jenkins felt that the proposed internal layout of the development would not be suitable for use as the bathroom facilities are accessible through the kitchen.  He also expressed concern in relation to  the inadequate public transport links and informed the committee that Ruabon Road is not served by numerous bus routes. Therefore he recommended that the application be refused.  The committee concurred the view expressed by the Local Member.

 

RESOLVED – That permission be REFUSED

 

Reason

The development will give rise to an increase in demand for on-street parking in the vicinity of the site, exacerbating existing parking problems to the detriment of highway safety and residential amenity.  The proposals therefore conflict with policy GDP1(d) and(f) and policy T8 of the Wrexham Unitary Development Plan.

Objections had been received from the Community Council.

 

The Local Member (Councillor John McCusker) reminded the Committee that the property is on a private estate and is obscured by trees but is in a conservation area.

 

Councillor John Phillips agreed with the concerns raised by the  Community Council and was not supportive of the application as in his opinion the use of uPVC guttering would have a detrimental impact upon the character of the Overton Conservation Area.

 

RESOLVED – That permission be REFUSED

 

Reason

The use of uPVC guttering will have a detrimental impact upon the character of the Overton Conservation Area.  The proposals therefore conflict with policy EC7 of the Wrexham Unitary Development Plan.

Mr Michael Tait (Neighbour) spoke against the application.

 

The Local Member (Councillor J R Skelland) spoke about the application and whilst confirming that he was not objecting to the application, he felt that the applicant should be responsible for the construction and long term maintenance of the boundary fence.

 

RESOLVED -  that the Reserved Matters be approved.

No windows shall be installed at any time in the west facing elevation of the dwelling, as shown on drawing no. HS092/02 Revision A, other than windows that are non-opening and obscure glazed. 

 

Reason

 

To protect the amenities of the occupiers of nearby properties in accordance with Policy GDP1 of the Wrexham Unitary Development Plan.

A neighbouring ward Member (Councillor R Alun Jenkins) spoke about both applications relating to this site and confirmed that he was in agreement with the Conservation Officer that Listed Building consent should be granted.

 

Further information was requested in respect of how the flats would be accessed by tenants, how bins would be emptied and whether Members could be given access to the building in order to conduct a site visit.

The Chief Officer Planning & Regulatory submitted a report (COPR/43/19) submitted a report to consider written representations made in respect of Tree Preservation Order (TPO) WCBC 293/2019 – “Llwyneinion Woods, Rhosllanerchrugog, Wrexham” and to determine whether or not to confirm the TPO and make permanent with or without modification.

 

Officers advised that consideration had been given to the potential risk to grazing horses at the site.
